These Terms of Service (“Terms”) govern your access to and use of the digital storefront, website, social media channels, WhatsApp ordering systems, and electronic customer services offered by Little One Pala, located at Pala Municipal Building, Main Road, Pala, Kottayam, Kerala - 686575.

1. Acceptance of Terms

By browsing our digital catalog, placing an order via WhatsApp or phone, or interacting with our online services, you agree to comply with and be bound by these Terms of Service, alongside our Privacy Policy, Shipping Policy, and Return Policy.

2. Service Availability & Modifications

We reserve the right to modify, suspend, or discontinue any product category, service feature, or promotional offer at any time without prior notice. We shall not be liable to you or any third party for any service modification, price change, or product discontinuation.

3. Customer Account & Communication Consent

  • Contact Accuracy: You agree to provide accurate, current, and complete information (including valid name, shipping address, mobile phone number, and email address) when interacting with us.

  • Electronic Consent: By providing your mobile number and email, you expressly consent to receive order confirmations, DTDC tracking links, local delivery notifications, customer satisfaction inquiries, and occasional product updates via SMS, WhatsApp, or Email.

  • Opt-Out: You may opt out of promotional communications at any time by notifying us via email or WhatsApp. Transactional notifications (such as dispatch updates) will continue until order completion.

4. Prohibited Uses

You are strictly prohibited from using our site, services, or catalog content for:

  • Any unlawful, fraudulent, or malicious purpose under Indian law.

  • Impersonating any person or submitting false delivery addresses or fake payment details.

  • Scraping, copying, or duplicating product images, logos, or written content for commercial unauthorized use.

  • Abusive, harassing, or threatening behavior towards store staff or delivery personnel.

5. Intellectual Property Rights

All trademarks, brand names, product photographs, logos, and content associated with Little One Pala are the intellectual property of Little One Pala or used under permission from respective manufacturers. Unauthorised copying or redistribution is strictly prohibited.

6. Disclaimer of Warranties

All digital services and product information are provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, whether express or implied. Little One Pala does not guarantee that website access or catalog messaging will be uninterrupted or error-free.

7. Indemnity

You agree to indemnify, defend, and hold harmless Little One Pala, its proprietor, and employees from any claims, losses, liabilities, or legal expenses resulting from your breach of these Terms of Service or violation of applicable laws.

Welcome to Little One Pala (“Store”, “we”, “us”, or “our”), located at Pala Municipal Building, Main Road, Pala, Kottayam District, Kerala, India - 686575. These Terms and Conditions constitute a legally binding agreement between Little One Pala and any individual or entity (“Customer”, “you”, or “your”) accessing our physical store, purchasing goods, or utilizing our digital, telephone, WhatsApp, or online ordering services.

[IMPORTANT NOTICE] By placing an order, browsing our catalog, or making a transaction with Little One Pala, you confirm that you have read, understood, and agreed to be bound by all terms, conditions, and disclaimers contained herein.

2. Product Disclaimers & Safety Rules

2.1 Toys, Small Parts & Choking Hazard Warnings

Many toy items contain small parts, marbles, or detachable components. Unless explicitly labeled for infants (0-36 months), all toys sold by Little One Pala are intended for children above 3 years of age under strict adult supervision. Little One Pala disclaims all liability for injuries, choking incidents, or misuse resulting from inadequate adult supervision.

2.2 Remote Control (RC) Toys, Drones & Battery-Operated Goods

RC cars, RC excavators, drones, and electronic toys are delicate mechanical/electronic items:

  • No Impact/Crash Warranty: We perform quality checks prior to dispatch. There is strictly no warranty for physical damage, crashes, high drops, or collisions occurring after receipt.

  • Battery & Charging Care: Customers must follow charging instructions. Do not leave rechargeable batteries unattended, overcharge overnight, or use unapproved chargers. Damage caused by reverse battery polarity, liquid exposure, or short-circuiting is strictly excluded from coverage.

  • Mandatory Opening Video for DOA Claims: If an RC toy or battery item is received in a Dead On Arrival (DOA) state or damaged condition, a mandatory uncut 360-degree unboxing video must be submitted within 48 hours of delivery.

2.3 Baby Clothing & Fabrics

Product colors shown in digital catalogs or photographs may vary slightly from actual fabrics due to screen resolution and studio lighting. Sizing charts are indicative. Due to strict hygiene standards, washed, worn, or un-tagged baby clothing cannot be returned or exchanged under any circumstances.

2.4 Ride-On Vehicles

Ride-on cars, bikes, and manual push cars carry maximum payload weight limits as specified in product descriptions. Exceeding recommended weight limits, driving on rough unpaved roads, or exposing electrical components to rain/water voids all support. Assembly by customer is required unless local delivery assembly service is requested.

3. Pricing, Orders & Payment Terms

  • Pricing in INR: All prices listed are in Indian Rupees (₹) and are subject to change without prior notice.

  • Official Payment Channels: Payments must be made via authorized store UPI IDs, official bank transfer accounts, recognized online payment gateways, or cash at our Pala counter. Little One Pala is strictly not responsible for payments sent to unauthorized third parties or unverified personal UPI accounts.

  • Cash on Delivery (COD): COD may be offered for select pincodes subject to phone verification. Little One Pala reserves the right to charge a non-refundable COD convenience fee or cancel COD orders if phone verification fails.

  • Refused COD Orders: Refusing delivery of COD orders at doorstep without a valid reason will result in permanent blacklisting of the customer address and phone number for future COD purchases.

4. Limitation of Liability

To the maximum extent permitted under applicable law, Little One Pala, its proprietor, employees, and agents shall not be liable for any indirect, incidental, punitive, or consequential damages arising from the use of products sold. Our aggregate liability for any claim shall under no circumstances exceed the actual purchase price paid by the customer for the specific item in dispute.

5. Force Majeure

Little One Pala shall not be held liable for failure or delay in fulfilling delivery or service obligations if such delay is caused by acts of God, floods, severe weather, courier strikes, transport disruptions, lockdowns, government regulations, or events beyond our reasonable control.

6. Governing Law & Dispute Resolution

These Terms and Conditions shall be governed by and construed in accordance with the laws of India. Any legal proceedings, disputes, or claims arising out of or relating to Little One Pala shall be subject to the exclusive jurisdiction of the competent Courts at Pala / Meenachil / Kottayam, Kerala, India.
